Privacy Policy for AVideo AI

This privacy policy applies to the AVideo AI application (hereby referred to as "Application") for mobile devices, created by Tahsin KAPSAL (hereby referred to as "Service Provider"). The Application is provided as a Freemium service and is intended for use "AS IS".

1. Information Collection and Use

The Application collects information when you download and use it. This includes:

• Device Information: IP address, operating system, device model, and app usage statistics (time spent, features used).
• Account Information: When you sign in with Apple or Google, we receive your name and email address from those platforms. This information is used solely to create and manage your account within the Application.
• User-Provided Content: To provide core AI features, the Service Provider requires access to User-Selected Media (Photos, Images, and Videos) that you choose to upload.
• Text Prompts: The written descriptions you provide to guide the AI generation process.
• Purchase Information: Subscription and transaction records processed through the App Store or Google Play, managed via RevenueCat.
• Crash and Error Data: Technical diagnostic information collected via Sentry when the Application encounters an error, including device type, OS version, app version, and stack traces.
• Analytics and Attribution Data: App install source, campaign identifiers, and usage events collected via AppsFlyer to understand the effectiveness of our marketing campaigns.
• Push Notification Token: A device token used to deliver push notifications. This does not identify you personally and is used solely to send you notifications related to the Application.
• Customer Support Data: When you contact us via our Support Center or by email, we collect your name, email address, and the content of your message. This information is used solely to respond to your inquiry and improve the Application. Support data is retained for up to 2 years and is never shared with third parties.

2. AI Data Processing and Third-Party Sharing

To provide our AI video and art generation features, the Application transmits user-provided content to third-party AI infrastructure providers.

• Alibaba, MiniMax, Tencent (Hunyuan)
• fal.ai and Replicate (Infrastructure API connectors)
• ShengShu Technology (Vidu), Ideogram, Higgsfield, PixVerse

C. Purpose and Protection

Data is transmitted solely to generate the requested AI content. These providers are contractually or legally prohibited from using your personal media for their own independent purposes. We do not use your personal data to train third-party AI models without your explicit consent.

3. Face Data Policy

The Application may process photos or videos containing faces to apply specific artistic styles or face-swap effects.

• No Biometric Identification: We do not use face data to identify, authenticate, or create biometric profiles of users.
• Processing & Retention: Face data is processed on-the-fly by AI providers. We do not store face data beyond the time required to generate output. Partners must delete such data after processing (typically within 24 hours).

4. Third-Party Services for Operations

The Application uses the following third-party services for operations, stability, analytics, and subscription management:

• Google Play Services — Core Android app functionality. Privacy Policy
• Apple App Store Services — Core iOS app functionality. Privacy Policy
• RevenueCat — In-app purchase and subscription management. Privacy Policy
• AppsFlyer — Marketing attribution and install analytics. Collects device identifiers (IDFA/GAID), IP address, and app event data. Privacy Policy
• Sentry — Error tracking and crash reporting. Collects device information, OS version, IP address, and error diagnostic data. Privacy Policy

5. Data Retention

We retain your data only as long as necessary to provide the Service or as required by law:

• Account data: Retained for the duration of your account. Deleted within 30 days of account deletion request.
• AI-generated content: Stored on our servers until you delete it or delete your account.
• Uploaded media (photos/videos): Transmitted to AI providers for processing and not retained by us beyond what is needed to deliver the result. AI providers delete this data after processing.
• Crash and error logs (Sentry): Retained for up to 90 days.
• Analytics data (AppsFlyer): Retained in accordance with AppsFlyer's data retention policy.
• Purchase records: Retained for up to 7 years as required for financial and legal compliance.

6. Sign In with Apple & Google

The Application allows you to sign in using your Apple or Google account. When you do so:

• We receive your name and email address from Apple or Google to create and manage your account.
• We do not receive your Apple or Google password.
• Apple may anonymize your email address (Hide My Email feature). In this case, the anonymized address is used for account communication.
• The data received from Apple or Google is governed by their respective privacy policies: Apple Privacy Policy and Google Privacy Policy.

7. Push Notifications

The Application may send push notifications to your device to inform you about completed AI generations, new features, or important updates.

• What we collect: A unique device push notification token, which does not personally identify you.
• How to opt out: You can disable push notifications at any time through your device settings (iOS: Settings → Notifications → AVideo AI; Android: Settings → Apps → AVideo AI → Notifications). Disabling notifications does not affect your use of the Application.

8. App Tracking Transparency (iOS)

On iOS 14.5 and later, we display Apple's App Tracking Transparency (ATT) permission prompt before collecting any data used for tracking purposes (specifically, for AppsFlyer attribution and marketing analytics).

• If you allow tracking, AppsFlyer may access your device's IDFA (Identifier for Advertisers) to attribute app installs to advertising campaigns.
• If you deny tracking, no IDFA will be collected. The Application will continue to function normally. Only aggregated, non-identifiable analytics may be collected.
• You can change your tracking preference at any time in: Settings → Privacy & Security → Tracking → AVideo AI.

9. International Data Transfers

Because our AI infrastructure partners (such as OpenAI, Google, etc.) operate globally, your information, including personal data and uploaded media, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction. By consenting to this Privacy Policy and using the Application, you agree to that transfer.

For users in the European Economic Area (EEA) or United Kingdom, such transfers are carried out subject to appropriate safeguards, including Standard Contractual Clauses (SCCs) as approved by the European Commission.

10. Your Data Protection Rights (GDPR)

If you are located in the European Economic Area (EEA) or United Kingdom, you have specific rights regarding your personal data under the General Data Protection Regulation (GDPR). These rights include:

• The right to access, update, or delete the information we have on you.
• The right of rectification (to correct inaccurate information).
• The right to object to processing.
• The right of restriction.
• The right to data portability.
• The right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

11. User Consent and Opt-Out Rights

By using the AI generation features, you explicitly consent to the transmission of your media to AI providers.

• Opt-Out of Analytics: You can limit ad tracking through your device settings (iOS: Settings → Privacy → Tracking; Android: Settings → Privacy → Ads).
• Opt-Out of All Collection: You can stop all data collection by uninstalling the Application.
• Data & Account Deletion: You can delete your account and all associated data at any time using the "Delete Account" function within the Application, or by contacting us at support@avideoai.app. We will process your request within 45 days.

13. Refund Data Sharing with Apple

If you request a refund for an in-app purchase through Apple's App Store, we may share the following consumption data with Apple to help them evaluate your refund request:

• Time elapsed since the app was installed
• Total time the app was used
• Whether the in-app purchase was consumed or used
• Whether a free trial was previously used
• Anonymous account identifiers
• Total purchase amount and total amount previously refunded

This data is shared solely to assist Apple in making informed refund decisions and is handled in compliance with applicable privacy laws. By using the Application, you consent to this data sharing for refund handling purposes. If you wish to opt out, please contact us at support@avideoai.app.

14. Children's Privacy

The Application does not knowingly collect data from children under the age of 13. If such data is discovered, it will be deleted immediately. If you are a parent or guardian and believe your child under 13 has provided us with personal information, please contact us at support@avideoai.app and we will take prompt action.

15. Security

The Service Provider is committed to protecting your information. We implement appropriate technical and organizational measures to safeguard your personal data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure, and the Service Provider cannot guarantee absolute security.

16. Changes to This Privacy Policy

This Privacy Policy may be updated from time to time. The Service Provider will notify you of any changes by updating the "Last Updated" date at the top of this page and, where appropriate, by notifying you within the Application. Your continued use of the Application after any changes constitutes your acceptance of the updated Privacy Policy.
